I've got some Tabernaemontana seeds that have penicillium mold growing on them. Is it likely to effect the embryo or is it just after the remaining flesh on the outside of the seed.

I would clean them off with a very dilute bleach solution and inspect them. If the seed is soft enough to crush between your fingers then the embryo is rotten, if not then they have a good chance of sprouting.
If left long enough it will definitely destroy the embryo.
